Do I require an Electrical safety check? If so, when?

Rental providers have certain responsibilities for electrical safety. Electrical appliances need to be regularly checked and maintained. Rental providers need to make sure that the appliances are working safely.

Rental providers who enter into a new agreement after 29 March 2021, or have a fixed term agreement of more than five years which rolls over into a periodic tenancy after 29 March 2021, must ensure that:

Electrical safety checks are conducted every two years, and

if an electrical safety check has not been conducted within the last 2 years at the time the renter occupies the premises, the rental provider must arrange an electrical safety check as soon as possible.

If the rental provider entered into the rental agreement before 29 March 2021, the rental provider is still responsible for maintaining the safety of the premises. Energy Safe Victoria recommends that electrical safety checks be undertaken every two years.

What do you receive once the test has been completed?

A digital report prepared in accordance with Section 2 of AS/NZS 3019 “Electrical installations – Periodic Verification” which outlines:

The name of the licensed electrician who conducted the check.

License number of the electrician.

The date the check was conducted.

The results of the check including any repairs that were required and actions taken to address the repair.

What is required by the landlord if repairs are required?

If required, the landlord must repair any faults immediately. Depending on the severity and danger of the repair some may need to be repaired before any tenants can reside. We can provide a quote for you but recommended you find a licensed electrician than can quote and repair the work for you to avoid any conflict of interest.

What is generally involved in an electrical safety check?

Our electrician will test and inspect the fixed electrical installations in the property. For example: wiring, plug sockets, light fittings, fuse boxes, electric showers and extractor fans. We can make any immediate hazards safe before we leave your home.

What is an Annual Essential Safety Measures Report (AESMR)?

An AESMR is a statutory document mandated by the Victorian Government, which establishes a framework for yearly reporting by building owners or their agents, ensuring that essential safety measures in a building or place of public entertainment are maintained and functioning properly.

Owners are responsible for maintaining ESMs for an entire building and/or place of public entertainment, as specified in various regulations.

Can a building owner appoint someone else to handle the AESMR process?

Yes, under Section 240 of the Building Act 1993, an owner may authorize another person in writing to act as their agent and handle applications, appeals, referrals, or representations on their behalf.

When should an AESMR be prepared?

Regulation 223 requires that the AESMR be prepared within 28 days before each anniversary date of the first occupancy permit or maintenance determination issued for the building or place, or if there is no occupancy permit.
